Public Terms of Service & SDK License Agreement

These Public Terms of Service ("Terms") govern your access to and use of dophys.top, the dophys-core numerical solver SDK, container images, public API gateways, and technical monographs provided by DoPhys Research Labs ("DoPhys", "we", "us").

Effective Date: October 29, 2025 Last Updated: November 7, 2026 Applies to SDK v2.4.x-LTS & Cloud Endpoints
Section 01

Acceptance of Terms & Scope

By downloading, installing, or executing dophys-core packages, pulling container images from our registries, or accessing any web or API service hosted under *.dophys.top, you agree to be bound by these Terms on behalf of yourself and the academic institution, research laboratory, or corporate entity you represent. Where your organization has executed a separate Master Software License Agreement (MSLA) with DoPhys Research Labs, the terms of that MSLA prevail in the event of a conflict.

Section 02

SDK License Tiers & Usage Grants

Subject to continuous compliance with these Terms, DoPhys grants you a non-exclusive, non-transferable license to execute the dophys-core binaries and Python/C++20 headers according to your provisioned tier:

License Tier Permitted Scope Compute & Redistribution Terms
Academic & Research (Free) Non-commercial academic research, thesis work, and coursework at accredited degree-granting institutions. Up to 8 GPUs / node; no commercial redistribution; citation required.
Commercial R&D Evaluation Internal benchmarking, mesh convergence validation, and solver integration testing (30-day term). Non-production use only; offline Ed25519 time-bound token.
Enterprise Source + HIL Runtime Commercial production deployment, hardware-in-the-loop (HIL) embedded deployment, and custom kernel modification. Unlimited cluster nodes; source escrow & dedicated ABI support.
Section 03

Acceptable Use Policy & Gateway Rate Limits

To preserve deterministic quality of service across our distribution mirrors and public API endpoints, you agree not to:

  • Reverse Engineering of Proprietary Preconditioners: Decompile, disassemble, or extract PTX/SASS microcode from closed-source algebraic multigrid (AMG) or hardware-in-the-loop runtime modules, except where explicitly permitted by statutory law or an Enterprise Source license.
  • Gateway Abuse & Credential Sharing: Share individual license tokens across unaffiliated organizations, bypass rate-limiting controls (10–20 req/s per IP on public gateways), or perform unauthorized port scanning or automated vulnerability fuzzing against *.dophys.top infrastructure.
  • Export Control Violations: Use or export the SDK in violation of Swiss SECO, EU Dual-Use, or U.S. Export Administration Regulations (EAR), including prohibited military nuclear, biological, or missile proliferation activities.
Section 04

Intellectual Property, Simulation Outputs & Academic Citations

4.1 Ownership of Simulation Outputs: You retain 100% ownership and intellectual property rights over all meshes, initial conditions, PDE configurations, neural surrogate weights, and numerical simulation outputs generated using dophys-core.

4.2 Open-Source Interface Headers: The Python bindings, JAX XLA custom-call wrappers, and C++20 interface headers distributed via public repositories are licensed under the Apache License 2.0.

4.3 Academic Attribution: Publications, preprints, or technical reports utilizing the Academic & Research license tier must cite the corresponding DoPhys technical report (see Technical Reports & BibTeX Archive).

Section 05 • Engineering & HIL Notice Verification Required

Numerical Verification & Safety-Critical Systems Disclaimer

While DoPhys Core kernels undergo continuous automated verification against $142$ Method of Manufactured Solutions (MMS) PDE benchmarks ($L_2$ and $L_\infty$ error norms) and discrete symplectic energy conservation checks:

Numerical approximations of partial differential equations are inherently subject to discretization error, floating-point rounding ($\epsilon_{\text{mach}} \approx 2.22 \times 10^{-16}$ in FP64), mesh quality degradation, and boundary-condition modeling assumptions. You are solely responsible for independent physical validation, safety margins, and hardware-in-the-loop (HIL) fault-containment before deploying any solver output in aviation, autonomous vehicles, medical devices, nuclear, or structural engineering systems.

Section 06

Public Infrastructure Availability & SLA

DoPhys targets $99.95\%$ quarterly uptime across package mirrors, license verification endpoints, and documentation portals (real-time metrics available on Cluster Status). Scheduled maintenance windows and emergency security patches are announced via the status telemetry feed. Formal financial SLA credits apply exclusively to Enterprise MSLA subscribers.

Section 07

Warranty Disclaimer & Limitation of Liability

EXCEPT AS EXPRESSLY PROVIDED IN A SIGNED ENTERPRISE AGREEMENT, THE SERVICES AND SDK ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. IN NO EVENT SHALL DOPHYS RESEARCH LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOLVER KERNELS OR PUBLIC INFRASTRUCTURE.

Section 08

Governing Law & Legal Contact

These Terms are governed by and construed in accordance with the substantive laws of Switzerland (excluding the UN Convention on Contracts for the International Sale of Goods), with exclusive jurisdiction in the courts of Zurich, Switzerland.
